What "legal for trade" means

A legal-for-trade scale is one that may lawfully determine weight in a commercial transaction — any time money changes hands on the number the scale produces. A quarry selling crushed stone by the ton, a landfill charging disposal by the ton, a recycler buying scrap by the pound: all of it legally requires a scale that is type-approved, installed, tested, and sealed under the weights-and-measures law of the state it operates in.

Run commerce across a non-certified scale and the transactions themselves are exposed — plus the fines, and the risk of the device being ordered out of service. The good news is the requirements are consistent and knowable, because nearly every state builds on the same two pillars: NIST Handbook 44 and NTEP.

The rulebook: Handbook 44, NTEP, and your state

Three layers govern a commercial truck scale, and they cover different things:

One line to keep straight: the CoC certifies the model, Handbook 44 governs the device, and the state certifies your specific installation. Buying an NTEP-approved scale is necessary but not sufficient — it still has to be placed in service and kept in tolerance under your state's program.

How accurate a truck scale actually has to be

Vehicle scales fall under Handbook 44 accuracy Class III L — the class covering vehicle, axle-load, livestock, railway track, and similar large-capacity scales. And here's where an honest article has to push back on a number you'll see quoted all over the industry: "truck scales are accurate to 0.05%" is not what Handbook 44 says.

Handbook 44 expresses tolerance in scale divisions (the increment the scale displays — typically 20 lb on a full-size vehicle scale). For Class III L, the maintenance tolerance is 1 division up to 500 divisions of applied load, 2 divisions from 501 to 1,000, then one more division for each additional 500. Work that out on a real scale and you get roughly 0.2% of the applied load — and the acceptance tolerance, applied when a scale is new or freshly repaired, is half that, roughly 0.1%:

Two takeaways. First, a scale can be perfectly legal and still be ±80 lb on a 20-ton load — which is why serious operations treat the tolerance as an outer boundary, not a target. Second, drift inside the tolerance is invisible without testing, and at hundreds of loads a day even a small consistent bias compounds. The tolerance protects the transaction's legality; only calibration discipline protects your margins.

The testing cycle: who shows up, and how often

Inspection frequency is set state by state, and annual testing is the common pattern. Two concrete examples: Wisconsin requires the owner of any commercial vehicle scale of 5,000 lb capacity or more to have it tested at least annually by a licensed scale service (ATCP 92.30); in California, county weights-and-measures offices inspect, test, and seal commercial scales, and most counties require annual device registration. Many heavy-use operations test more often by choice — quarterly or semi-annually — precisely because of the drift math above.

Budget-wise, calibration and maintenance are private-market services: industry-published figures put truck scale maintenance in the range of $1,000–$10,000 per year depending on service level, with technician labor commonly $125–$200/hour. Treat those as industry-reported ballparks, not regulatory numbers.

One niche worth knowing if you haul on state highway projects: DOT contract specs can impose their own weighing rules on top of weights-and-measures law. Wisconsin DOT's construction manual, for instance, requires truck tare weights to be re-determined at least once each day on department projects — stricter than anything general commerce requires, and a good example of why "certified once a year" isn't the whole compliance story.

When a scale fails: condemnation

When an official test finds a scale out of tolerance, the device is rejected and tagged out of commercial service. The statutory language varies — Virginia marks devices "Condemned for Repairs"; Iowa tags them "condemned until repaired" — but the effect is the same everywhere: the scale may not be used commercially again until it has been repaired and re-examined by the authority that rejected it.

For a single-scale operation that's an existential sentence: no legal weighing means no legal selling. The practical defenses are unglamorous — keep the test cycle current, keep the deck and approaches clean, watch for drift between tests (comparing stored tares against fresh weighs is a cheap early-warning signal), and keep your calibration certificates where you can produce them.

What must end up on the ticket

Certification doesn't stop at the load cells — Handbook 44 also reaches the record the scale produces. A commercial weighing must be a complete operation with gross, tare, and net determined, any computed net weight must be mathematically correct (net + tare = gross, exactly), and where a recorded representation is required it must be made available to the customer — on paper, or electronically with the customer's consent.
